We sell furnishings and appliances for the house. On occasion, we will run deals or provide discounts on our items.

Cancellation Refund Policy

Indemnification

Arbitration

If the parties are unable to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any of their provisions, whether in contract, tort, or otherwise at law or in equity for damages or other relief, such dispute shall be resolved only by final and binding arbitration conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar ad hoc body.

The arbitrator's decision is final, and any court with jurisdiction may enter judgment on it. The successful party shall be entitled to collect its costs and reasonable attorney's fees if any legal or equitable action, proceeding, or arbitration arises out of or concerns these Terms and Conditions. All disputes and claims relating to these Terms and Conditions, or any issues originating as a consequence of these Terms and Conditions, whether directly or indirectly, including Tort claims occurring as a result of these Terms and Conditions, will be arbitrated by the parties. The Federal Arbitration Act will regulate the interpretation and implementation of this clause, according to the parties. The Arbitrator will decide on the whole issue, including the scope and enforceability of this arbitration clause. This arbitration clause will remain in effect even if these Terms and Conditions are terminated.

Individual arbitrations and class/representative/collective actions are not authorized under these Terms and Conditions. THE PARTIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Furthermore, unless you and ASAYF agree otherwise, the arbitrator may not combine more than one person's claims and may not preside over any sort of representative or class action.

The information herein is updated on a regular basis. At any time, ASAYF and/or its suppliers may make improvements and/or changes to the site. ASAYF and/or its suppliers do not warrant or represent the suitability, reliability, availability, timeliness, or accuracy of the information, software, products, services, and related graphics contained on the site for any purpose. All such information, software, products, services, and related graphics are provided "as is'' without warranty or condition of any kind to the maximum extent permitted by applicable law.

ASAYF and/or its suppliers disclaim all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. 

The above limitation may not apply to you because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. Your sole and exclusive remedy if you are dissatisfied with any portion of the site or with any of these terms of use is to stop using the site.

ASAYF maintains the right, at any time and without notice, to terminate your access to the Site and connected services, or any part thereof. This agreement is governed by the laws of the State of Indiana to the fullest extent permissible by law, and you hereby consent to the exclusive jurisdiction and venue of courts in Indiana in any disputes arising out of or connected to the use of the Site. Any country that does not give effect to the terms of these Terms, including, without limitation, this clause, is prohibited from using the Site.

As a consequence of this agreement or your use of the Site, you agree that no joint venture, partnership, employment, or agency relationship exists between you and ASAYF.

ASAYF's performance of this agreement is subject to existing laws and legal process, and nothing in this agreement limits ASAYF's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by ASAYF with respect to such use. If any part of this agreement, including, but not limited to, the warranty disclaimers and liability limitations set forth above, is found to be invalid or unenforceable under applicable law, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the agreement will continue in effect.

Unless otherwise stated, this agreement contains the entire agreement between the user and ASAYF with regard to the Site and replaces all prior or contemporaneous discussions and proposals, whether electronic, oral, or written, between the user and ASAYF with respect to the Site. In judicial or administrative proceedings based on or relating to this agreement, a printed version of this agreement and any notice given in electronic form shall be admissible to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. The parties expressly agree that this agreement, as well as any connected papers, be written in English.

Changes to Terms

ASAYF maintains the right to amend the Terms under which https://asayf.com is supplied at any time. All earlier versions of the Terms will be superseded by the most recent version. ASAYF recommends that you examine the Terms on a regular basis to remain up to speed on our changes.
